NASHUA — Hudson resident Chanphanou Pou, who owned the Tutti Frutti Frozen Yogurt store in Pheasant Lane Mall when he was arrested in mid-2022 on charges accusing him of installing a hidden recording device in a store bathroom, has notified the court he plans to enter guilty pleas to the three charges he’s facing.
Pou, 45, agreed to plead guilty to three counts of violation of privacy in exchange for agreeing to undergo counseling and register as a sex offender with the state registry.
The charges were amended to Class A misdemeanors as part of the agreement.
The sides agreed on a capped plea hearing, which means the prosecution and defense will each present their cases to the judge and recommend a sentence, after which the judge will decide the terms of the sentence.
The hearing is scheduled for 10 a.m. Monday, May 20, in Hillsborough County Superior Court South.
One of the three charges carries a sentence of up to 12 months in jail. The sentence the judge imposes will fall somewhere between no jail time and the full 12 months.
The other two 12-month sentences are both suspended for one year. If imposed, they will run consecutive to the first sentence.
According to the amended sentencing documents, Pou “purposely and unlawfully installed a recording device in a public bathroom (at Tutti Frutti) ... with the purpose of observing, photographing, recording, amplifying, broadcasting ... or in any way transmitting images or sounds of the private body parts ... “
It’s not clear who initially discovered, and reported, the device in the bathroom. But police detectives assigned to the investigation determined that Pou concealed the device, prompting them to issue a warrant for his arrest.
